Chapin F. Cimino, Virtue and Contract Law
This paper argues that virtue theory can offer a more complete understanding of private law, specifically contract law, than current dominant theories. Law and economics and individual rights theories fail to account for both the means and ends, by prioritizing one over the other. The paper aims to show that virtue theory provides a better understanding of parties’ intent and intent-based doctrines.
